Terms and Conditions of Sale

MAKETIS SAS is registered in the Trade and Companies Register under number RCS 811 025 782. Its head office is located at 1 Avenue de Verdun - 77610 FONTENAY-TRESIGNY – France, and its email address is contact@maketis.com.

Any order placed for a product listed on the online store of the website www.maketis.com implies prior consultation and acceptance of these General Terms and Conditions of Sale. Validation of the GTC during the ordering process constitutes full acceptance and has the value of a “digital signature”.

These general terms and conditions aim to define the rights and obligations of the parties in the context of the online sale of goods offered by MAKETIS SAS to the consumer.

In the event of a closure of MAKETIS SAS due to annual leave, participation in an exhibition, or exceptional unavailability, the duration and period of closure will be displayed on the homepage. Preparation and delivery times will start running from the first day of reopening.

Product presentation

The characteristics of the products offered for sale are presented in the product sheets on our website. Photographs are not part of the contractual field. MAKETIS SAS cannot be held liable for any errors that may have occurred. The photographs of products sold in kit form showing possible assembly or usage suggestions do not guarantee the final result for each user. All texts and images displayed on the website of MAKETIS SAS are protected worldwide under copyright and intellectual property law; their reproduction, even partial, is strictly prohibited without prior written authorization from MAKETIS SAS.

Duration of offer validity

Products are offered for sale while stocks last or subject to availability from our suppliers. If an ordered product becomes unavailable, the customer will be informed as soon as possible by email or postal mail. The customer may then choose to request either a refund within fourteen days at the latest, a discount voucher valid on www.maketis.com for an amount equal to the initial purchase price, or an exchange. MAKETIS SAS also offers customers the possibility of ordering any other product from its suppliers’ catalogues not listed on the website www.maketis.com. Custom-made or personalized products may also be considered. Such requests must be made via the contact form available in the customer area, and conditions (price, lead time, shipping costs) will be reviewed on a case-by-case basis according to supplier availability.

Product pricing

The prices indicated for each item are expressed in euros, all taxes included (VAT), excluding shipping and packaging fees. The total shipping and packaging cost is displayed during product selection and is updated with each new item added to the cart. The VAT amount is shown on the order confirmation issued at the end of the purchase process and sent to the customer by email.

MAKETIS SAS reserves the right to modify its prices at any time, but products are billed at the rate in effect at the time the order is recorded. The proposed prices include any discounts and rebates that MAKETIS SAS may grant based on its results or if certain services are handled by the buyer. No discount will be granted for early payment.

Orders

The customer validates the order by clicking the “I confirm my order” button at the bottom of the “Order Summary” page after having accepted these terms and conditions. Before this validation, the customer is systematically invited to check each element of the order and may correct any possible errors. The delivery address must be filled in accurately and can be modified at any time in the “My Account” section. The information provided by the buyer during the order process is binding: in case of an error in the recipient’s details, MAKETIS SAS cannot be held responsible for the inability to deliver the product.

Contractual information will be confirmed by email to the address indicated by the consumer in the order form.

The data recorded by MAKETIS SAS constitutes proof of the nature, content, and date of the order. The order is archived by MAKETIS SAS under legal conditions and time limits; the customer can access this archive by contacting Customer Service or by logging into their account on www.maketis.com.

Payment methods

To pay for an order, the customer has several payment options:

• By credit card (Carte Bleue, Visa, Eurocard/Mastercard): Fully secured transaction (SSL, 3D Secure payment), processed via the secure PAYZEN platform (online payment solution by Lyra Network Group) automatically at the end of the ordering process.
• By cheque (France only): If you choose to pay by cheque, please write your order number on the back of the cheque and send it to: MAKETIS SAS - 1 Avenue de Verdun - 77610 FONTENAY-TRESIGNY. Due to an increase in bounced cheques, your order may be shipped up to 15 days after the cheque has cleared to verify solvency.
• By bank transfer: Using our bank details provided at the end of the ordering process.
• Payment in installments with ALMA:
  Payment in multiple installments or deferred payment is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
  Purchase amount: Only purchases between €150 and €2,000 are eligible for Alma payment.
  Fees: Paying in installments with Alma incurs no additional fees for the customer.
  Alma is the electronic payment manager and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with Articles 1316 and following of the French Civil Code.
  Termination: Any termination of the GTC binding the Seller and the customer also terminates the T&Cs between Alma and the customer.
  
  Alma’s credit service is available for purchase payments and execution, provided that the buyer accepts the installment or deferred payment contract. Additional fees may be charged by Alma. Any refusal by Alma to grant installment or deferred payment may result in cancellation of the purchase contract, unless the buyer agrees to pay the full amount upfront. In the event of termination of the GTC, the installment payment contract will be automatically terminated. If the installment or deferred payment is withdrawn, the GTC will also be automatically terminated unless payment is made in full through Alma. If the product has already been shipped, it must be returned within the time frame provided in these GTC.

Once payment has been validated, you will receive confirmation by email. Your order will be shipped within 24 to 48 hours after payment is received. MAKETIS SAS reserves the right to cancel any order for which payment has not been received within 7 days.

Right of withdrawal

The right of withdrawal applies only to private individuals. In accordance with Articles L.120-20 of the French Consumer Code, the consumer has a period of fourteen (14) calendar days to return, at their own expense, any products that do not meet their expectations. This period begins on the day the consumer receives the order. Any return must first be reported to the MAKETIS SAS customer service department using the return form available on www.maketis.com (“Order Tracking” – “Return Merchandise” section). The product must be returned to MAKETIS SAS, 1 Avenue de Verdun - 77610 FONTENAY-TRESIGNY.

This right of withdrawal cannot be exercised, unless otherwise agreed by the parties, for goods made to the consumer’s specifications or clearly personalized. Only products returned in their entirety, in their complete and intact original packaging, and in perfect resale condition will be accepted. Any product that has been damaged or whose original packaging has been deteriorated will neither be refunded nor exchanged. This right of withdrawal is exercised without penalty, except for shipping and return costs.

If the right of withdrawal is exercised, the consumer may choose either a refund or an exchange. In the case of an exchange, reshipping costs are borne by the consumer. In the case of a refund request, MAKETIS SAS will reimburse the buyer for all amounts paid, as soon as possible and at the latest within 14 days from the date on which this right was exercised.

Late payment (clause applicable to professionals)

In the event of total or partial non-payment of goods delivered on the due date, the buyer must pay MAKETIS SAS a late payment penalty equal to one and a half times the legal interest rate. The applicable legal interest rate is the one in force on the day of delivery. This penalty is calculated on the untaxed amount remaining due and runs automatically from the due date without any prior notice being required.

In accordance with Articles 441-6 and D.441-5 of the French Commercial Code, any late payment automatically entails, in addition to the late penalties, the obligation for the debtor to pay a fixed compensation of €40 for collection costs. Additional compensation may be claimed, with supporting documentation, if collection costs exceed this fixed amount.

Delivery terms

Any order for products in stock will be shipped within 24 to 48 working hours after payment is received (excluding weekends, Mondays, and public holidays). The delivery time of the selected carrier must be added to calculate the estimated delivery date. Products are delivered to the address indicated by the consumer on the order form.

As with any shipment, delays or loss may occur. In such cases, we contact the carrier to initiate an investigation. All necessary efforts are made, for as long as required, to locate the parcel. If necessary, MAKETIS SAS will be reimbursed by the carrier and will reship an identical parcel at its own expense. We disclaim any liability for extended delivery times caused by the carrier, especially in cases of product loss, bad weather, or strikes.

Delivery issues caused by the carrier

Any delivery anomaly (damage, missing product, damaged package, broken items, etc.) must be indicated on the delivery slip in the form of “handwritten reservations”, accompanied by the client’s signature. The consumer may choose to refuse the goods and ask the carrier to return the parcel to MAKETIS SAS along with a “theft or damage report” (form 170).

The consumer must also confirm this anomaly by sending the carrier a registered letter with acknowledgment of receipt within 3 working days following delivery, outlining the complaint. A copy of this letter must be sent to MAKETIS SAS. Without this report, no exchange can be made.

The consumer may exercise their right of return even if no reservations were made at delivery, provided they notify both the carrier and the seller by registered letter with acknowledgment of receipt within 3 days, stating that the product was damaged or tampered with during transport.

Delivery errors

The consumer must notify MAKETIS SAS, on the day of delivery or no later than the third working day following delivery, of any delivery error and/or non-conformity of the products in kind or quality compared to the details listed on the order form. After this period, any claim will be rejected. Complaints may be submitted via the customer service contact form available on www.maketis.com, or by mail to MAKETIS SAS - 1 Avenue de Verdun - 77610 FONTENAY-TRESIGNY.

Any claim not made in accordance with the above procedures and deadlines will not be taken into account and will release MAKETIS SAS from any liability to the consumer.

In the event of a delivery error, any product to be exchanged or refunded must be returned to MAKETIS SAS in full, in its original packaging and in perfect condition. To be accepted, all returns must be reported and pre-approved by MAKETIS SAS, which, if approved, will reship the parcel to the correct address. Shipping costs are borne by MAKETIS SAS, except where the returned product does not match the consumer’s original declaration on the return form.

Product warranty

The provisions herein do not deprive the consumer of the legal warranty that obliges the professional seller to guarantee against all consequences of hidden defects in the sold item.

The consumer is expressly informed that MAKETIS SAS declines all responsibility for defective products that it is not the manufacturer of. In the event of damage caused to a person or property due to a defective product, only the manufacturer’s liability may be sought by the consumer, based on the information provided on the product packaging.

The warranty period is two (2) years. Excluded from this warranty are all products modified or repaired by the customer or any third party other than service providers approved by MAKETIS SAS.

Force majeure

Neither party shall be held liable for failure to perform its contractual obligations if such non-performance results from an event of force majeure. Force majeure refers to any irresistible, external, unforeseeable, unavoidable event beyond the control of the parties, which cannot be prevented despite all reasonable efforts. The party affected by such circumstances must notify the other within ten working days from the date it becomes aware of them. The parties shall then consult within three months (unless impossible due to the force majeure event) to assess the impact of the event and agree on the conditions under which the contract will continue. If the case of force majeure lasts more than one month, these general terms and conditions may be terminated by either party without compensation.

Expressly considered as cases of force majeure or fortuitous events, in addition to those recognized by French case law, are: transport blockages, earthquakes, fires, storms, floods, lightning, interruptions of telecommunications networks, or difficulties related to external telecommunications networks.

Partial invalidity and waiver

If one or more provisions of these general terms and conditions are deemed invalid or declared as such pursuant to a law, regulation, or final decision of a competent court, the remaining provisions shall remain fully valid and enforceable.

Failure by either party to enforce any provision of these general terms and conditions shall not be construed as a waiver of the right to enforce it in the future.

Applicable law

These general terms and conditions are governed by French law. This applies to both substantive and procedural rules. In the event of a dispute or claim, the consumer shall first contact MAKETIS SAS to seek an amicable resolution.

Personal data protection

All data you provide to us is required for processing your orders. In accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files, and civil liberties, you have the right to access, rectify, consult, modify, and delete the data you have provided to MAKETIS SAS. This right may also be exercised online.

Disputes

Any order placed via the website www.maketis.com constitutes full acceptance by the customer, without restriction, of the General Terms and Conditions of Sale of MAKETIS SAS. In the event of a sale to a legal entity, any dispute relating to the sale (price, GTC, products, etc.) shall be subject to French law and brought before the Commercial Court of the registered office of MAKETIS SAS.
